Note :

  1. FOR ALL STATES CONSIGNEE PARTY'S " ST & CST " NUMBER IS COMPULSORY.
  2. 10 % or 14 % CST applicable only for own used materials. For sales, the receiving party must have local sales Registration certificate. The precentage of Tax may varies product to product and as per local surcharges of each state. i.e. In Karnataka 5 % cases will be levied on the Tax.
  3. For A.P, Kerala, Punjap & H.P. ST form will be issued by entry check post, not by the Consignee and the same will be filled by the driver/agent at the check post. But Consignee's ST & CST Nos. are must.
  4. Movement of material in between interstate Bihar & Jharkhand no PERMIT is required. ST form 28 B are different for Bihar & Jharkhand.
  5. In karnataka form 39 will be issued by the Consignor for specified goods like Iron, Steel, Rejected/Repaired, re-conditioned and stock transfers etc. at the time of the booking. CST & KST Number of Consignee is must in Consignment Notes & Invoice copy for all Incoming Materials.

1 Shipper's Warranties and Indemnity
Shipper shall indemnify and hold AFS Worldwide Express harmless for any loss or damage arising out of Shipper's failure to comply with any applicable laws or regulations and for Shipper's breach of the following warranties and representations:

      1. All information provided by Shipper or its representatives is complete and accurate;
      2. the Shipment was prepared in secure premises by Shipper's employees;
      3. Shipper employed reliable staff to prepare the Shipment;
      4. Shipper protected the Shipment against unauthorized interference during preparation, storage and transportation to AFS Worldwide Express.
      5. the Shipment is properly marked and addressed and packed to ensure safe transportation with ordinary care in handling;
      6. all applicable customs, import, export and other laws and regulations have been complied with; and
      7. The waybill has been signed by Shipper's authorized representative and the Terms and Conditions constitute binding and enforceable obligations of Shipper.

 

 
 

2 Unacceptable Shipments
Shipper agrees that its Shipment is acceptable for transportation and is deemed :
unacceptable if:

      1. It is classified as hazardous material, dangerous goods, prohibited or restricted articles by IATA (International Air Transport Association), ICAO (International Civil Aviation Organization), any applicable government department or other relevant organization.
      2. AFS Worldwide Express decides it cannot transport an item safely or legally (such items include but are not limited to: animals, bullion, currency, bearer form negotiable instruments, precious metals and stones, firearms, parts thereof and ammunition, human remains, pornography and illegal narcotics/drugs).

 3 AFS Worldwide Express Liability
AFS Worldwide Express contracts with Shipper on the basis that AFS Worldwide Express  liability is strictly limited to direct loss . AFS Worldwide Express will only issue a C.O.F ( Certificate of Fact ) for the consignments which are damage, broken or stolen at the time of transporting goods from one destination to another in AFS transhipments. As we carry the consingment on said to content bases,AFS Worldwide Express has right to monitor the shipment whether it is well packed and safe for transporting. or after acceptance of the Shipment since special risks can be insured by Shipper. All other types of loss or damage are excluded.


4 Time Limits for Claims
All claims must be submitted in writing to AFS Worldwide Express within thirty (7) days from the date that AFS Worldwide Express accepted the Shipment, failing which AFS Worldwide Express shall have no liability whatsoever.


5 Delayed Shipments

AFS Worldwide Express will make every reasonable effort to deliver the Shipment according to AFS`s regular delivery schedules, but these are not guaranteed and do not form part if the cause is due to:-"Act of God" - e.g. earthquake, cyclone, storm, flood, fog; "Force Majeure" - e.g. war, plane crash or embargo; any defect or characteristic related to the nature of the Shipment.
